ARTICLE 7 : DELIVERY AND RISK TRANSFER
7.1 – Country of delivery
Products purchased on the website www.autotuner-tool.com can be delivered to many countries including Luxembourg, Germany, Belgium and mainland France (Corsica included), provided that the Products can be delivered in accordance with the national regulations of the country in which the delivery address indicated by the buyer is located and/or any other international regulations that may be applicable.
The buyer is solely responsible for compliance with the national regulations of the country in which the delivery address indicated by the buyer is located and/or any other international regulations that may apply.
The country of delivery must be the same as the country of invoicing.
7.2 – Delivery process
The Products must be delivered to the delivery address indicated by the buyer when entering the information during his Order. The delivery does not include the installation or the commissioning of the ordered Product, nor the return of old equipment.
In the event that delivery is impossible because it contravenes the national regulations of the country in which the delivery address indicated by the buyer is located and / or any other international regulations that may apply, the buyer will be solely responsible for this situation and will not be able to claim any reimbursement on this account.
If the buyer does not take delivery in good time of a Product he has ordered or if he makes delivery impossible by his absence, the indication of a false address or for any other reason attributable to him, the seller will be authorized to invoice him for all costs caused by the failure to take delivery by the buyer.
Unless other conditions than those provided for in these general conditions of sale are applied, the delivery costs are always the responsibility of the buyer.
7.3 – Delivery times
Outside the seller's annual holiday periods, subject to the availability of the Product and except in cases of force majeure, the seller undertakes to ship the Product within five working days of the validation of the payment by the payment service indicated on the site. Delivery times depend on the destination country and the Carrier's work. The seller can in no way be held responsible for a delay in delivery after having insured the shipment of the Product.
7.4 – Risk transfer
Upon delivery of the Order to the Carrier, the Products are placed under the responsibility of the buyer who then bears all risks of loss or damage.
7.5 – Product quality check and damages
It is the buyer’s responsibility to check the conformity of the Products and the condition of their packaging upon delivery. Any damage must be the subject of precise reservations, dated and signed, on the delivery slip. In the event of loss or damage related to transport, the buyer must exercise his recourse against the Carrier.
